TalkTalk have apparently decided that they're going to enforce their exit fees if anyone decides that staying with a company that have had data stolen for what was at least the third time might not be a good idea. They'll only waive them if you show that you've actually had money lifted.
As long as you give 30 days notice, I'm sure you can avoid exit fees. I did it with Virgin. I had moved to an area they didn't cover, but was still under contract. The way I seen it, they were in breach of the contract by not providing me with the service I was paying for.
If Talk Talk aren't protecting their users data, I'd say that was sufficient grounds for the termination of the the contract. I'm no lawyer, obviously, but I can see them getting forced to if it goes to court and then they'll have a mass exodus on their hands and poison the well of consumer trust. Look at BT, the amount of abuse their sales department gets is extraordinary with people saying they wouldn't come back even if it was free.

There is more to my post than the bit you quoted, I would have hoped it was obvious from the context that I was giving an example of when giving 30 days notice of termination worked despite the contract having a while to run.
